www.isntshepretty.co.uk is the website address for Isn't She Pretty Limited (Registered office Office 215 Great Northern House, 275 Deansgate, Manchester M3 4EL Company Registration Number 6513747) (hereafter referred to as "the Company", "Isn't She Pretty" "we" or "us"). All use of the Company's website is on the terms set out below and the terms apply to all pages of www.isntshepretty.co.uk If you do not agree with any of these terms then please cease use of the website now. All visitors to this website are bound by these terms and conditions and the terms form a contract between us so you may wish to print off a copy for future reference. We reserve the right to change the terms from time to time to meet the needs of the business and any changes will be posted here.

Access to this Website may be restricted, suspended or terminated at any time.

1.   INFORMATION

a.   Please remember that if you use this website you are responsible for maintaining the confidentiality of your account and any passwords and should ensure you restrict access to your computer to prevent unauthorized access to your account. You must inform us immediately if you have any reason to believe that your password has become known to anyone else or if it may be being used in any unauthorized manner.

b.   Please ensure that the details you give to us are complete and up to date and notify us of any changes to the information you provide to us.

c.   We make every effort to ensure that our website is accurate and up to date. Please advise us as soon as possible in the event you notice any inaccuracies or other problems with the website.

d.   Please ensure you check independently on any information before you rely on it. Whilst we use do our utmost to ensure information is correct at the time of posting on the site no representations are made by us that all information is accurate, up to date and complete and we shall not be liable in any way for any loss or damage arising from any inaccuracy in any information or information which is out of date. All information is provided free of charge.

e.   We reserve the right to refuse access to the website, to terminate customer accounts, to remove or edit website content or to cancel any orders if necessary. In the event the Company cancels an order it will be without charge to you.

2.   ORDERING, SHIPPING AND DELIVERY

a.   All services supplied or goods purchased from us are subject to these terms and conditions.

b.   You confirm that you are over 18 years old.

c.   You may order Goods from the Web Site by submitting a completed order form.

d.   Please note that all orders are subject to availability.

e.   We aim to keep items in stock at all times, however there may be rare instances when the items are unavailable therefore it will not be possible to order any item that is not in stock.

f.   All items in the Isn't She Pretty collections have been carefully selected to reach optimum standards of quality. Please be aware that whilst we take great care to describe all our products, some of the items are handmade or customized and so, are unique- therefore some of the colours and design may slightly vary.

g.   What is the total price I will have to pay?
For all orders there is just one small fee per order. UK orders over £50.00 are free postage, excludes poles. See our delivery chart below to find out the cost. This does not apply to Pole Packages additional fees will apply for poles.

h.   How long will you take to dispatch my items?
If we receive your cleared payment before 5pm GMT we aim to process and dispatch your order the next working day. For all Pole Delights Pole Packages we also require floor to ceiling height measurement before your order can be processed. We will get your pole cut the next working day and booked in for collection the following working day. For orders placed after 5pm GMT they will be processed the following day.

i.   How will my package be sent?
Your package will be sent in plain discreet packaging marked for the addressee. Our name and contact details may be displayed on the outside of the packaging. For Customs declarations and as required by certain carriers a basic description of the contents maybe displayed on the outside in small wording. Pole Delights Pole Packages will have customised packing tape on the outside. If you do not wish to have the customised tape please notify us at the time of placing your order.

j.   What is the cost and delivery time for items delivered to the UK (Excluding Pole Delights Pole packages)?
We deliver to all addresses in the UK covered by Royal Mail standard 1st class. This includes Isle of Man, Isle of Douglas, Channel Islands, Shetland Isles, Orkney Isles, Guernsey, Isle of Scilly and Northern Ireland. Delivery time is normally 1 - 2 days from date of dispatch.
We can offer Recorded Signed For, where you can track your parcel online. Once dispatched your package should be delivered 1 - 2 days from date of dispatch.
We also offer Special Delivery, where you can track your parcel online. Once your package has been dispatched then it is guaranteed by the carrier to arrive the next working day, not guaranteed for Saturday. We will send your parcel by either Royal Mail or our own designated courier. The choice of carrier will be at the discretion of the Isn't She Pretty.

k.   What is the delivery cost and delivery time for a dance pole package to UK?
The price to deliver a Pole Delights Package costs £14.99 for UK mainland addresses. Once we have your floor to ceiling height we aim to get your pole cut the next working day. It is then booked in for collection the following day. Once collected the courier offers next day delivery.
If you live in Isle of Man, Isle of Douglas, Channel Islands, Shetland Isles, Orkney Isles, Guernsey, Isle of Scilly and Northern Ireland please check with us first. Courier charges sometimes vary for outside mainland UK.
Please remember to provide the exact floor to ceiling height in order that your package can be dispatched. We cannot send any package without this measurement.
Once dispatched the Pole Delights Fitness Dance Pole Package will be delivered the next working day, excluding Saturday. You can track your parcel online and it will require a signature at the delivery address. If there is nobody available to accept delivery the courier will leave a card and contact number for you to arrange a suitable delivery day. If you request your parcel is left without a signature we cannot guarantee the safety of your package. We cannot accept liability for any losses caused if not signed for.
Under exceptional circumstances on occasions there may be a delay with the courier once the package has been collected. Unfortunately any delays once collected will be outside our control. We will do our best to contact the courier and try to resolve any problems on your behalf.
Other poles including the X-Pole, we aim to dispatch within 48 hours of receiving your order, normally arriving in 2 working days. The cost to ship to UK is £14.99.

l.   What countries do you ship to and what is the cost?
We are able to ship all of our items by Royal Mail and courier services to most destinations in the world. We can send your parcel by Internationally Signed For delivery. This requires a signature at the destination address and can be tracked online. All Internationally Signed For delivery parcels are sent on next available flight and are given priority in both the UK and abroad. Delivery to outside the UK cannot be guaranteed, but the aim is to deliver to Western Europe 3 days following posting, Eastern Europe 4 days following posting and outside Europe 5 days following posting. Delivery once in the destination country depends upon local services. For more information on Royal Mail services please visit the Royal Mail Website. 
X-Poles cannot be shipped to all countries, please contact us if you live outside of the UK and wish to order an X-Pole.

m.   Is my package insured against loss?
All packages are covered for up to £36 compensation by the carrier in the unlikely event of loss or damage in transit. For UK delivery, only Special Delivery will provide compensation of up to £500. For worldwide delivery, only the Internationally Signed For will be sent with compensation up to £500. Pole Delights Pole Packages are covered for loss or damage in transit up to the value of the standard pole kit. If you wish to obtain additional cover any additional items sent with your Pole Delights Pole then please contact us to arrange the additional insurance.

n.   Will I have to pay any Customs charges for goods delivered to an address outside the UK?
It is a legal requirement that we declare the full value of the goods on all packages sent outside the European Union and these specific EU destinations: Andorra, Canary Islands, Gibraltar, San Marino and Vatican City State. Shipments sent to these destinations may be subject to import duty, tax and customs clearance charges. Unfortunately we do not have any control over these charges. The addressee must pay for all additional charges.

View the price to send poles to European Zones and Worldwide Zones. Please contact us if you wish to obtain additional compensation for your Pole Delights Pole package or you require a personal quote.

q.   X-Pole packages. The cost to send an X-Pole to a UK address is £14.99. If more than one pole is required discounted postage may be available, please contact us first. We also deliver to Ireland £19.99, France £24.99, Germany £24.99 and Spain £34.99. We aim to dispatch your order within 2 working days.

r.   The Company will confirm acceptance of your order by e-mail to the e-mail address you supply and the sending of this e-mail, whether or not the same is received by you, is confirmation of the details of the order and of the contract with us. Please make sure you provide us with the correct e mail address and ensure that your e mail is in full working order.

s.   The Company shall not be liable for any problems caused by you supplying faulty information (such as the wrong email address or wrong delivery address) or due to your failure to make any particular specification.

s.   No statements made in these terms or on this Web Site shall be deemed to affect the statutory rights of a consumer which cannot be restricted or excluded currently under the law.

t.   Every effort is made to ensure that the information featured on the website is correct, in the case of errors being made Isn't She Pretty will endeavor to remedy, replace or refund goods as quickly as possible from the time of being made aware of the situation, we will not be held liable or responsible for any losses as set out in the limitations of liability section of these terms.

u.   It is the responsibility of the customer to notify Isn't She Pretty immediately if there are any delivery problems or if the goods ordered are unfit for purpose, not as described on the Web Site or not of satisfactory quality.

v.   All products and services and postage and packaging must be paid for in full prior to the dispatch of goods ordered unless agreed in writing. Once an order has been placed and processed it may not be cancelled without due cause.

3.   PRICE AND PAYMENT TERMS

a.   The Price of the Goods shall be the price quoted on the Web Site at the time your order is accepted. We try to ensure that all details including prices are displayed accurately and are to date. Obviously prices may vary from time to time so please make sure you check all the relevant details before you place an order with us as prices may have altered since you last visited our site.

b.   You can pay for your items via the secure online payment system Protx using the following payment cards: Visa, Visa Delta/Debit, Visa Electron, Mastercard, UK Maestro, Solo and American Express. We do not store any credit card details or other sensitive information at www.isntshepretty.co.uk. All transactions are processed by Protx, who use bank approved software and the highest level of encryption to ensure that your credit card details are kept secure at all times. The Protx certificate may be viewed by clicking on the padlock at the bottom of the payment pages.

c.   Payments can be accepted online using Protx. If you are paying online for goods with a total value in £ GBP sterling using another currency, your issuer will transfer the funds at the appropriate rate. Please refer to your issuer for full details.

d.   We also accept payments via Paypal. In addition to the cards accepted by Protx. Please be aware occasionally there may be delays with receiving payments if you choose to pay by Paypal eCheque. Our Paypal email address is admin@isntshepretty.co.uk.

e.   All eCheque payments as shown as pending in the first instance. An eCheque payment is made using an Electronic Funds Transfer. This process usually takes four working days to complete using a US bank account, seven to eight working days using a Canadian bank account, and seven to nine working days using a United Kingdom bank account. However, the transfer could somehow be delayed during processing, which could mean the transaction takes up to eleven to fifteen working days to complete. Although the funds may have cleared the sender's bank account, they still have to go through the Federal Reserve Bank and then through Paypal system. Once the funds have been transferred, the status of the transaction will automatically change to 'Cleared' and the funds will be placed in our account. It is only at this point that we can release any goods.

f.   If you prefer not to pay by a credit or a debit card you can opt to pay by cash, cheque, postal order or direct into our company bank account. Simply place an order in your cart and click 'BACS, Postal Orders, Cheques & Cash' button at the end of the checkout. You should receive an email confirming the amount of your order and your order number.

g.   For us to continue processing your order simply reply to the email letting us know how you intend to make payment for your goods. You can also send us a message on using our contact us page. You will need to ensure you quote your unique order number, date of order, total amount due and your email address with all correspondence. We will be able to view your order online in our administration area. We will then confirm your order and reserve the goods for you for 7 days. If we have not received your payment once 7 days have passed we will no longer reserve the goods for you.

h.   If you wish to send us any messages or make any changes to your order this can be done by emailing admin@isntshepretty.co.uk using our contact us page. Please be sure to quote your unique order number, date of order, total amount due and your email address with all correspondence.

i.   You can pay by sending cash, cheque or postal order made payable to Isn't She Pretty Ltd and sending to our company address: Isn't She Pretty Ltd, Office 215 Great Northern House, 275 Deansgate, Manchester M3 4EL.

j.   We regret we are unable to accept GBP (£ sterling) for all forms of currency paid by cash, cheque, postal order or direct into our account. All currency sent this way must be exchanged at the appropriate conversion rate prior to sending to us.

k.   If you are sending a payment from outside of the UK you must ensure that you send in GBP (£ sterling). If you send the payment from outside the UK direct to our bank account you must cover all sender and receiver charges. If the bank payment credited to our account is reduced as the charges have not been covered then we will be unable to release the goods.

l.   All cheques are subject to full clearance and bank payments must be credited and show as the funds being available before any orders will be processed. We always allow 5 working days once banked for full clearance of all cheques. If you are sending cash we advise that you send as a Special Delivery package if using Royal Mail. We cannot accept liability for any payment that suffers loss, damage or any form of delay.

m.   All prices are exclusive of VAT (value added tax) and if applicable this shall be charged by Isn't She Pretty and shall be payable by you at the appropriate rate.

o.   These terms of sale are subject to change without notice and are correct at time of writing. our items are available in one size and are able to fit a range of sizes. For more information on our sizes please see our Size Guide Chart.

4.   CARING FOR YOUR OUTFITS & HOISERY

a.   Always follow the manufacturer's instructions in connection with care and washing of your goods. In the absence of any manufacturer's instructions follow the guidelines below.

b.   It is recommended that you hand wash your outfits and hosiery in luke warm with suitable washing detergent. When washing ensure jewellery is removed to avoid snagging hosiery and delicate fabrics.

c.   After hand washing outfits and hosiery can be hung to dry. Some materials are best not wrung out, but wrapped in a towel and gently pressed.

d.   Most of the outfits are not suitable for placing in the washing machine. But if you do insist on using a washing machine then use only a cool 30 degree wash on a gentle cycle and place in a separate laundry bag to prevent pulls and to protect it whilst in the washing cycle.

e.   Do not add heat or other chemicals as this may damage the fibres. This includes radiators, sun, ironing and chemicals such as nail varnish remover. Many of the outfits and the hosiery are made from delicate material so it is best they are treated with care to ensure a longer wearing product.

5.   RETURNS

a.   As you are buying Goods over the internet you may have rights under the Distance Selling Regulations which currently give you the legal right to cancel your order within seven (7) working days of receiving the Goods ordered. Please note that these regulations do NOT APPLY to certain items including but not limited to ANY BESPOKE ORDERS or certain goods which cannot be returned due to Health and Safety regulations.

b.   All of our items are checked thoroughly before dispatch. However if you find an item to be faulty, please contact us either by email, letter or fax within 7 days of delivery to advise us of the problem. We will give you a reference number that must be quoted with your returned item. You will also need to complete and enclose a returns form with your returns parcel.

c.   We need to receive your item back within 14 days of your delivery date.

d.   Once we have received the faulty item we may need to turn the item back to the manufacturer for inspection. Once we have confirmation that the product is faulty then we can arrange for a replacement or a refund. The decision as to whether an item is faulty is at the discretion of Isn't She Pretty. Payments will be refunded within 30 days.

e.   If the fault is not reported within a reasonable time, we reserve the right to refuse a full refund and offer pro rata compensation.

f.   We reserve the right to occasionally vary the item slightly from its picture or description. Please be aware that different monitor resolution settings and the age of your monitor may affect the brightness and colour of the item picture.

g.   If the item is not as described or shown in the picture or if you change your mind and you wish to return a product you will need to contact us requesting the cancellation of your goods and giving your reason. This must be done within 7 days of you receiving the goods and we must be advised in the form of an email, letter or fax. We will give you a reference number that must be quoted when you return the item. We need to receive your item back within 14 days of your delivery date.

h.   All returns must be unworn, unmarked, in original packaging and containing all tags. The items must be free from smoke and other odours. Reasonable care of the goods must be taken whilst in your possession. In the case of DVD's the box must be sealed. In the case of hosiery the packet must be unopened.

i.   We are only able to accept returns on items containing knickers / panties / shorts where the item has been tried on over your own panties.

j.   For hygiene reasons we are unable to accept returns on earrings.

k.   We do not normally accept returns on any Pole Delight Pole packages as these items are made to your specification and are not covered under the Distance Selling Rules Regulations. If you change your mind and wish to return a Pole Delights Pole then we may be able to allow the package to be returned. We will need to arrange for the item to be returned by courier. The courier will collect within their standard working hours. The pole will need to be in the same condition it was when dispatched, in the same packaging and must be unused. You will be required to pay both delivery and return postage plus an admin fee for restocking the item.

l.   For example if you have chosen standard UK mainland delivery for a short pole you will be charged per pole at 2 x £14.99 for P&P plus £20.00 admin fee, a total of £49.98. We will refund back to you the remainder of your payment once we are satisfied the above conditions have been met. We can only accept returns on poles that can be restocked for resale. If your pole is cut to fit a short ceiling height this may be excluded. Allowing custom made items to be returned is at our discretion.

m.   If these conditions are met we will be happy to exchange the item or issue a refund. We do not offer refunds on postage, accept in cases of faulty goods. For refunds for orders returned that were ordered with free delivery, we reserve the right to make a charge for postage costs. For exchanges we reserve the right to charge additional postage.

n.   Isn't She Pretty reserves the right to send the goods back to you if it is deemed these conditions have not been met. We reserve the right to charge you any additional postage. We reserve the right to charge an admin fee for goods that do not meet these conditions. Payments will be refunded within 30 days.

o.   We cannot accept liability for any returns that are posted but not received. We are unable to cover the cost of any returns for cancelled items. If the cancelled goods fail to be returned, we will seek to claim full recovery of the value of the goods plus additional administration charges to cover the direct costs of recovery.

6.   COPYRIGHT, TRADE MARKS, GRAPHICS AND LOGOS

a.   www.isntshepretty.co.uk and Isn't She Pretty are the registered trading names and trade marks of the Company and may not be used by any other party without the Company's prior written consent. Any infringement of these rights will be pursued vigorously.

b.   All visual elements, screen layouts and material displayed on the Web Site belong to the Company unless otherwise specified e.g. reports or extracts from brochures / journals / articles or is copyright to our technology or content providers. All designs, artwork, photographs and copy shall remain the property of the Company or their relevant owner. We reserve the right to take whatever legal action may be necessary against any visitor or user of this site who is found to have infringed out rights to recover all consequential losses including but not limited to recovery of all associated costs.

c.   You may view, print or download the contents of the website for personal use but for no other purposes including but not limited to commercial use or re-publication.

j.   Isn't She Pretty will not accept liability for injury or damage caused by improper installation or improper use of the Pole Delights Pole. If you have any doubts on the installation of the pole then it is recommended that you seek professional advice.

k.   The onus is with the customer to provide the exact measurement in writing, by way of email, fax or letter. Isn't She Pretty will not accept liability for any Pole Delights Pole packages that are issued with an incorrect length due to error in the original measurement provided.

l.   All deliveries and returns are made according to the carrier's standard handling and time procedures. Isn't She Pretty do not hold any responsibility for delays, lost or damages incurred by the carrier or delays caused by the carrier being unable to obtain a signature at the address. If the customer requests a delivery to be left without a signature or in an unsecure place then Isn't She Pretty cannot be held responsible for any non receipt. For any queries regarding deliveries once they have been dispatched please contact the carrier.

m.   In the event of damage during transit, the customer must ask the courier to make a record of the damage at the time of delivery, prior to signing for the shipment. The customer must notify us straight away. If the package does not arrive the customer must notify us. Royal Mail will only consider an item to be lost after 15 working days (from the due date of delivery) for UK, 20 working days for Europe and 25 working days for the rest of the world, unless sent by a guaranteed service. The customer will be required to make a written statement by completing, signing and returning a non receipt ∕ damage claim form.

n.   The customer must agree to co-operate fully with the carrier and Isn't She Pretty as part of the investigations into the damage or loss. If a package is sent without sufficient insurance Isn't She Pretty will only consider claims for loss or damage of parcels for the value of the item(s) up to £36 maximum. If the carrier refuses to pay any claim due to the non co-operation of the customer, Isn't She Pretty will seek recovery from the customer the cost of any refunds or replacement items we have issued. The carrier will consider claims but not in the case of circumstances beyond their control such as fire, flood, explosion, adverse weather and traffic congestion. Consequential losses and damages which are beyond Isn't She Pretty's control shall not be paid unless covered by carrier insurance.
